These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors Human Design readings, coaching and consulting services, writing and editing services, research services, blog articles, and memberships ("Services"). By accessing or using the website of our Services, you approve that you have read, understood, and agree to be bound by the following Terms and have read our Privacy Policy.

DISCLAIMER: This website and our Services are in no way claiming to be professional medical or health advice. I am not a medical or mental health professional, and none of the information provided in any way shape or form, including any services or products, etc., should replace the advice of a medical professional. Who can use our website:
In order to use our website and/or receive our Services, you must be at least 13 years of age, or the legal age of majority in your jurisdiction, and possess the legal authority, rights and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Commercial purchasing and licensing terms and return policies:
When buying an item or service, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it and know what you are purchasing; (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our Services and/or for any of our products that are listed on the website. We reserve the right to change our process for products and/or services displayed at any time and to correct pricing errors that may inadvertently occur, without having to adhere to the previous price point. The fee for the products and/or services and any other charges you may incur in connection with your possible use of the service, such as taxes and possible transaction fees, will be charged upon checkout.

There are no refunds or exchanges on services purchased by rescheduling is available.

Readings can be rescheduled up to 48 hours before the start of the reading.

A reading is considered a no-show 15 minutes after the start time and will be terminated after that time. No refund or exchange will be made after no-shows.

Showing up late to an appointment will cut into the client's reading time. Readings will not be extended past their scheduled time slot to accommodate late arrivals.

If you purchase a reading, you are responsible for providing the correct birth information to receive the most accurate reading possible. If you purchase a reading, you agree that you have fully read all the details of what you are purchasing on the sales page.

Readings in no way constitute legal, financial, medical or other advice. Readings, whether using Human Design, astrology or any other vehicle or method, is not an exact science and is presented solely for your personal enjoyment.

As a reminder, Tay Francis cannot make predictions using Human Design or astrology but can explore and interpret the energies in your chart to help you make the most out of the cosmic energies and your Human Design energetics and gifts. By engaging in a reading, you understand that Tay Francis is not liable for any actions or incidents directly or indirectly that occur from the advice given from their services. These services do not replace professional medical or legal business advice and does not diagnose illnesses, including questions related to pregnancy and death. By purchasing a reading, you agree that you have read and understood the terms and conditions and the details of the disclaimer. By purchasing a reading, you agree to this disclaimer and release consultations and readings by Tay Francis of any and all liability/responsibility for actions or inactions.

All purchases of instant PDF downloads, videos or audios with instant access, and other immediately accessible materials are considered final and non-refundable. Instant access materials are available immediately after purchase and will be sent to you via the email address you provide.

If you purchase a service that includes Signal support, office hours are Tuesday - Saturday, 11am-4pm AST. Response times are 1-3 hours on average. Service Provider note: I exist as a neurodivergent person therefore I may need extra time to process information, access my deeper knowing, and respond appropriately. Additionally, I live with a chronic health condition which means that I can never know when my symptoms will flare up and when my body may require extra rest. I am not responsible for the outcomes that occur during our time together or afterwards. While I can offer my guidance based on my expertise and experience, I do not tell you what to do, I only empower you to make your own decisions.

Retention of right to change offering(s):
We may, without prior notice, change the Services, stop providing the Services or any features of the Services we offer, or create limits for the Services. We may permanently or temporarily terminate or suspend access to the Services without notice and liability for any reason, or for no reason.

Warranties & Responsibility and Return Policy Information:
We do not offer warranties of any kind. The information provided in readings and coaching sessions is just as such (information) and once a reading or coaching session is received or attended it cannot be “returned” under any circumstances. Information provided in readings and coaching sessions is correct according to the birth information provided by you prior to the session and the Service Provider’s reserved right to their way of teaching the subject.

Ownership of intellectual property, logos, artwork, and copyrights:
The Service and all materials therein, or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, downloaded digital PDF files, and all information therein, and all intellectual property rights related thereto are the exclusive property of Tene Francis-Phillip and The Empowerment Axis Consultancy. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works therefor in any way shape or form.

Right to suspend or cancel user account and access:
We may permanently or temporarily terminate or suspend your access to the Services without notice and liability for any reason, including if in our determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any Services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically renewed subscriptions to paid services, you may cancel such subscriptions at any time however, please note that such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment. In the event that you cancel your subscription within 10 days of payment, you may be eligible for a refund for the current month's payment. However, please be aware that no refunds will be available for cancellations made after this 10-day period.

Indemnification:
You agree to indemnify and hold Tene Francis-Phillip and The Empowerment Axis Consultancy harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website and any of the Services offered on the website.

Limitation of Liability:
To the maximum extent permitted by applicable law, in no event shall Tene Francis-Phillip and/or The Empowerment Axis Consultancy be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits goodwill, use, data or other intangible losses arising out of or relating to the use of, or inability to use, the Services.

To the maximum extent permitted by applicable law, Tene Francis-Phillip and The Empowerment Axis Consultancy assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our services; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms:
We reserve the right to modify these Terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website and our services after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these Terms or any future version of the Terms, do not use or access, or continue to use or access, the Website and/or the Services.

Marketing and promotional emails and content:
By providing your email address, mailing address, phone number, or any other contact information, you agree to receive promotional and marketing messages and materials from us. If you don’t want to receive such promotional and marketing material or notices, please notify us via email at ask@thetayfrancis.com at any time.

Preference of law and dispute resolution:
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the Republic of Trinidad and Tobago, without respect to its conflict of laws and principles. Any and all such claims and disputes shall be brought in, and you hereby consent to the, being decided exclusively by a court of competent jurisdiction located in the Republic of Trinidad and Tobago.
